The above public authority relied on sections 41 (actionable breach of confidence) and 43 (commercial interests) of FOIA to withhold the information. The Commissioner’s decision is that the public authority was entitled to rely on section 41 of FOIA to withhold the information. The public authority’s response to the requested also breached sections 10 and 17 of FOIA. The Commissioner does not require further steps to be taken.
