The complainant requested from Bangor University (the University), information relating to the landowner consultations for the Definitive Map Modification Order (DMMO) application for an alleged footpath. The University refused the request and cited regulations 12(3) and 13 of the EIR.
The Commissioner’s decision is that regulation 12(3) and 13 are engaged, but only in respect of some of the withheld information. He also finds the exception at regulation 5(3) of the EIR applies, as some of the information is the complainant’s own personal data.
The Commissioner requires the University to take the following steps to ensure compliance with the legislation:
• To disclose the withheld information, subject to redactions for some personal data as identified in the confidential annex.
The University must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
