  • Sector Central government
  • Decision(s) FOI 10(1): Not upheld

The complainant has requested information about the decision to leave the EU. The Cabinet Office relied on section 12 of FOIA (cost of compliance) to refuse the request.
The Commissioner’s decision is that the public authority was entitled to rely on section 12(1) of FOIA to refuse the request. The Commissioner also finds that the public authority complied with its section 16 obligation to offer advice and assistance.
The Commissioner’s decision is that the public authority failed to provide a response within 20 working days. By failing to provide such a response within the statutory time for compliance, the Commissioner finds that the Cabinet Office breached section 10(1) of FOIA.
The Commissioner does not require further steps to be taken.
