Secretary of State for the Home Department (Home Office)

1.    The complainant has requested information from the Home Office.  The Home Office states that it does not hold information within the scope of the complainant’s request.
2.    The Commissioner’s decision is that, on the balance of probabilities, the Home Office does not hold information within the scope of the complainant’s request.
3.    The Commissioner’s decision is also that the Home Office has breached sections 1 and 10 of FOIA by not stating at the outset in response to the complainant’s request that it did not hold the requested information.
