Northern Ireland Housing Executive

The complainant has requested information about the costs of a social housing project. The Northern Ireland Housing Executive (NIHE) refused the request, citing regulation 12(5)(e) (the confidentiality of commercial or industrial information) of the EIR. The Commissioner’s decision is that, whilst NIHE was correct to handle the request under the EIR, NIHE is not entitled to rely on regulation 12(5)(e), as it has not demonstrated that the exception is engaged. The Commissioner requires NIHE to disclose the withheld information (ie the withheld information provided to the Commissioner in NIHE’s submissions of 28 March 2025).
