The complainant has requested information about pipework and instances of tankers transporting sewage at a particular sewage treatment works. Severn Trent Water (STW) relied on regulation 12(5)(a) of the EIR (national security and public safety) to withhold the requested pipework diagram. The Commissioner’s decision is that STW was entitled to rely on regulation 12(5)(a) of the EIR to withhold the pipework diagram. He also finds that STW breached regulations 5(1) and 5(2) of the EIR by failing to make available the information it holds concerning the second part of the request. The Commissioner requires STW to take the following steps to ensure compliance with the legislation: Provide the complainant with the information it holds about tankering at the specified water treatment site.
