The complainant has requested information about enterprise capital funds. The British Business Bank (‘the Bank’) provided some information but relied on section 43 of FOIA (commercial interests), section 41 of FOIA (provided in confidence) and section 21 of FOIA (information accessible by other means) to withhold the remaining information. The Commissioner’s decision is that the Bank was entitled to rely on section 43 of FOIA to withhold some of the requested information. However, it was not entitled to rely on section 21 of FOIA to withhold the remaining information and it has since provided this to the complainant. The Commissioner does not require further steps.
