The complainant has requested, (i) The citations submitted in support of nominations for four named individuals, (ii) All records of discussion and meeting minutes at which the nominations were considered; and(iii) all correspondence between House of Lords Appointment Commission (“HOLAC”) and the Prime Minister relating to those appointments, including prior nominations.
HOLAC disclosed the citations for the successful appointments. It refused to confirm or deny whether it held information relating to any earlier unsuccessful nominations under section 37 (2) FOIA. It withheld the remaining information under section 37(1)(b) (honours) and section 41 (1)(b) (actionable breach of confidence) FOIA.The Commissioner’s decision is that HOLAC was entitled to rely on section 37(2) and 37(1)(b) , as stated, to refuse part of the request.
