The complainant requested information from Norfolk County Council (“the Council”) relating to correspondence between the Council’s Education Quality Assurance Intervention Regulatory Service (“EQAIRS”) and its Children Services Local Authority Designated Officer. The Council considered the request to be vexatious under section 14(1) (vexatious request) and so relied on section 17(6) of FOIA as a basis for not issuing a refusal notice. The Commissioner’s decision is that the request is vexatious under section 14(1) of FOIA and that the Council is entitled to rely on section 17(6) as a basis for not issuing a refusal notice. The Commissioner does not require the Council to take any steps.
