The complainant has requested information regarding the fleet of marked vehicles currently in service with Devon and Cornwall Police (DCP). DCP provided some information in scope of the request and relied on section 31(1)(a) – Law Enforcement of FOIA to withhold the remainder of the requested information.
The Commissioner’s decision is that section 31(1)(a) of FOIA is engaged in this circumstance and that the balance of the public interest favours maintaining the exemption. However, he has recorded a procedural breach of section 10(1) of FOIA due to DCP’s failure to provide a valid response to the request within the statutory time frame of 20 working days.
The Commissioner does not require any steps as a result of this decision.
