  • Decision(s) FOI 12(1): Not upheld

The complainant submitted a request for information about a specific prosecution reported in the media in 2016. The Crown Prosecution Service (CPS) refused the request citing section 12 of FOIA to do so.
The Commissioner’s decision is that CPS was entitled to rely on section 12(1) of FOIA to refuse the request and that CPS complied with its obligations under section 16 to offer advice and assistance.
The Commissioner does not require any steps as a result of this decision.
