The complainant has requested information about Devon County Council’s children’s services. Ofsted disclosed information within scope of part 4 of the request and explained that some information was already accessible (section 21(1) of FOIA). It applied sections 33(2) and 36(2)(c) of FOIA to parts 1-3 of the request. These exemptions concern audit functions and prejudice to effective conduct of public affairs, respectively. The Commissioner’s decision is as follows:
Ofsted doesn’t hold information within scope of part (1b) of the request, or any further information within scope of part (3). Section 33(2) of FOIA is engaged in respect of part (1a) and part (2) of the request. It’s not necessary for Ofsted to take any steps.
