The complainant submitted an information request to the Animal and Plant Health Agency (APHA) for Inspection Reports in relation to Scottish Salmon Farms.
The Commissioner’s decision is that APHA was not entitled to rely upon regulation 12(5)(e) (commercial or industrial information) of the EIR to withhold the requested information. Furthermore, the Commissioner has found that APHA’s handling of the request breached regulations 5(1), 14(2) and 14(3) of the EIR.
The Commissioner requires APHA to take the following steps to ensure compliance with the legislation.
• Disclose the withheld information with any personal data redacted in accordance with his guidance.
APHA must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
