The complainant has requested communications between the Council and a school about the implementation of an experimental traffic order. The London Borough of Lambeth (“the Council”) confirmed that it held information within scope of the request but that it was withheld in full with reliance on regulation and regulations 12(4)(d)(material in the course of completion. During the course of the Commissioner’s investigation the Council amended its position to also rely on regulation 12(4)(e)(internal communications) to withhold the requested information. The Commissioner’s decision is that Council is not entitled to rely on regulation 12(4)(d) or 12(4)(e) to withhold information. The Commissioner also finds a breach of regulations 5(2)(time limits) and 11(internal review). The Commissioner requires the Council to disclose the information within scope of the request with redactions made for personal data. The public authority must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
