The complainant has requested copies of correspondence or materials concerning the designation of Mineral Safeguarding Areas. Fermanagh and Omagh District Council (‘the Council’) provided a link to some of the requested information and relied on regulation 12(4)(d) of the EIR (material in the course of completion) to withhold the rest of the information. The Commissioner’s decision is that the Council was entitled to rely on regulation 12(4)(d) of the EIR to withhold the remainder of the information. The Commissioner does not require further steps.
