The complainant has requested from NHS Business Services Authority (NHSBSA) the calculation mechanism from which NHS bursary payments for medical students are derived. NHSBSA’s final position was that it doesn’t hold this information. The Commissioner’s decision is that NHSBSA holds the requested information but that to communicate it to the complainant would exceed the time and cost limit under section 12(1) of FOIA. NHSBSA breached sections 16(1) and 17(5) of FOIA which concern advice and assistance and the time for providing a section 12 refusal notice. The Commissioner doesn’t require further steps.
