London Borough of Enfield

1.    The complainant has requested information from London Borough of Enfield (“the Council”) about use and performance of Deprivation of Liberty Safeguards (“DoLs).  The Council provided links to some information and stated that it did not hold further information in relation to the remainder.  It also sought to apply section 21 of FOIA to the part of the information to which it provided links.
2.    The Commissioner’s decision is as follows: 
•    On the balance of probabilities, the Council holds no further recorded information relevant to the complainant’s request and has complied with section 1(1) of FOIA in that respect.
•    The Council has breached section 1(1)(1) of FOIA in that it has sought to apply section 21 of FOIA to information not held by it.
3.    The Commissioner therefore does not require the Council to take any corrective steps.
