Estyn

The complainant has requested internal communications from Estyn, the education and training inspectorate for Wales. Estyn relied on section 40(2) of FOIA (third party personal information) to withhold some of the information. The Commissioner’s decision is that the public authority has correctly relied on section 40(2) of FOIA to withhold the information. The Commissioner also considers that Estyn has, on the balance of probabilities disclosed all non-exempt information that it holds in scope of part four of the request. However, the Commissioner has recorded a breaches of section 1, section 10 and section 17 of FOIA. The Commissioner does not require further steps to be taken.
