The complainant has requested information relating to Kent Police’s use and enforcement of residence-based bail conditions for the period 1 January 2021 to the most recent available date (or a 36-month rolling period if more practical). Kent Police (“KP”) refused to comply with the request, citing section 12 of FOIA (cost of compliance) as its reasons for doing so. The Commissioner’s decision is that KP was entitled to rely on section 12(1) of FOIA to refuse the request. The Commissioner also finds that KP complied with its section 16 obligation to offer advice and assistance however the KP has breached both section 10 and section 17 of FOIA because of the delays in its response.
