The complainant requested information about a referendum relating to a proposed mayoral election. Plymouth City Council (the “council”) confirmed that it did not hold the information. In doing so it confirmed that any information relating to the matter would, in any event, be held by the Returning Officer – a separate entity to the council. The Commissioner’s decision is that the council correctly confirmed that it did not hold the requested information and that it complied with section 1(1) of the FOIA. The Commissioner does not require the council to take further steps.
