The complainant has requested information in respect of HIV policies and procedures.
Kent Police (the ‘public authority’) provided some information, informed the complainant that some of the information was not held and relied on section 12(2) of FOIA (cost of compliance) to refuse the rest of the request.
The Commissioner’s decision is that the public authority was entitled to rely on section 12(2) of FOIA to refuse the request for parts 9-10. He also finds that no further information is held in addition to what has now been disclosed for parts 1-8.
The Commissioner finds that the public authority has complied with its section 16 obligation to offer advice and assistance.
The Commissioner does not require further steps to be taken.
