OFQUAL

The complainant has requested copies of event notifications submitted to Ofqual concerning errors in braille versions of certain assessment materials. Ofqual relied on section 43 of FOIA (commercial interests), section 31(1)(g) of FOIA (law enforcement) and section 41 of FOIA (information provided in confidence) to withhold the requested information. The Commissioner’s decision is that Ofqual was not entitled to rely on sections 31(1)(g), 41 nor 43 of FOIA to withhold the requested information. The Commissioner requires Ofqual to take the following steps to ensure compliance with the legislation: Disclose the requested event notifications.
