Rhonnda Cynon Taf County Borough Council (“the Council”) relied on regulation 12(4)(b) to refuse the request. The Commissioner’s decision is that the Council has not sufficiently demonstrated that regulation 12(4)(b) is engaged. The Commissioner requires the Council to issue a fresh response to the request that does not rely on regulation 12(4)(b).
