The complainant submitted a request to the Ministry of Defence (MOD) seeking documents from the Royal Military Police's Special Investigations Branch Operation Tasker, into alleged rapes and murders by British soldiers in Kenya. The MOD disclosed some information in response to the request but redacted information on the basis of sections 27(1)(a) (international relations), 38(1)(a) (health and safety), 40(2) (personal data) and 41(1) (information provided in confidence). The Commissioner’s decision is that the redacted information is exempt from disclosure on the basis of section 27(1)(a) or section 40(2). The only exception to this is the name of the defence adviser which the Commissioner has concluded is not exempt from disclosure on the basis of section 40(2). The Commissioner also concluded that the MOD breached section 17(3) as it did not complete its public interest deliberations within a reasonable time.
