The dataset provisions relate to FOIA, not the Environmental Information Regulations (EIR). There are no corresponding provisions in the EIR. You should be aware of this, given that many of the datasets that requesters are likely to want to re-use will contain environmental information. However, if you receive a request for an environmental dataset and the requester asks for it in a re-usable form, you should consider your duties under regulation 6 of the EIR about making information available in a particular form or format. We consider that the term “a particular form or format” in regulation 6(1) of the EIR can cover a re-usable form. You should make the environmental dataset available in a re-usable form, so far as reasonably practicable. Although there is no duty to license re-use under the EIR, we would also encourage you to make the dataset available under a licence that permits re-use.
Information that is accessible under the EIR may also be the subject of a re-use request under the RPSI, if you are covered by the RPSI.
You should also be aware of your duties to make spatial data available under the INSPIRE regulations.
