How do we register as a relevant digital service provider?
If you are a relevant digital service provider (RDSP), Regulation 14 of NIS requires you to register with the ICO. This means that if you offer an online search engine, online marketplace or cloud computing services within the UK and are not exempt due to the size of your organisation you must register with the ICO. For further information about the definition of RDSP please see our page on digital service providers.
Unlike registration under data protection law, there is no fee required for NIS. You should register with the ICO by emailing NISRegistration@ico.org.uk with the subject line ‘RDSP registration details’, and include the following in your email:
- the name of your organisation;
- the name of your service;
- the address of your head office, or that of your nominated representative; and
- up-to-date contact details, including the name of a nominated individual who we can contact about NIS related matters if we need to, their email address and their telephone number.
You can also provide this information via our helpline on 0303 123 1113.
It is also important to note that although there is no fee to register under NIS, it is a separate registration process to that established under data protection law. If you are also a data controller, you need to register with us separately to pay the data protection fee.
How do we update our registration information?
If there are any changes to the information you have previously provided you should notify the ICO as soon as possible, and no later than three months after the change taking place.
If your organisation grows to the point that you meet the definition of an RDSP – for example, if you can no longer rely on the SME exemption – then you must register at the latest by the date three months after you met the definition.
You should update your registration with the ICO by emailing with the subject line ‘RDSP update registration details’, and include both the previous and updated version of the following in your email:
- the name of your organisation;
- the name of your service;
- the address of your head office, or that of your nominated representative; and
- up-to-date contact details, including the name of a nominated individual who we can contact about NIS related matters if we need to, their email address and their telephone number.
You can also provide this information via our helpline on 0303 123 1113.
